Things to consider:

  1. Has there been an independent review of the surrogate's medical insurance policy re: any exclusion for surrogacy related medical expenses?

  2. Have both parties completed psychological interviews?

  3. Have the parties agreed on the amount of contact during pregnancy and possible contact post birth?

  4. How many cycles do the parties intend to complete to achieve a viable pregnancy and birth?

  5. Are the parties in agreement regarding terms for therapeutic abortion and selective reduction?

Ovum and Sperm Donation

Things to consider:

  1. Disposition of untransferred embryos after all treatment cycles have been completed? (options include discard, donation for medical research, and donation to others for the purpose of conception)

  2. Will the donor be asked to register with the Donor Sibling Registry to facilitate the future exchange of medical information?

  3. Have all parties completed psychological interviews?

  4. Will the child be told about the ovum donation at an appropriate age?

  5. Is the donor open to direct contact with the child in the future upon request?

Embryo Donation

Things to consider:

  1. Disposition of untransferred embryos after recipients have completed all treatment cycles?

  2. Have both parties completed psychological interviews to address short term and long term issues?

  3. Will recipients assume payment of the balance of cryopreservation fees due?

  4. Will donors be informed of a resulting birth?

  5. Will the parties maintain future contact to exchange relevant medical information?

  6. Will biological siblings have the possibility of direct contact?
